Companies’ treatment of trademarks may vary based on their size and how long they’ve been established in the market place. For example, if a company has been around for 20 years and doesn’t have any legal issues regarding its name or logo design (like having too similar labels), then there won’t be much harm done by switching names over time—unless someone else was already using a similar concept before them!
As a business owner, you can protect yourself from becoming the victim of trademark infringement and unfair competition by doing several things before your company launches: Search for other companies with similar names. This step will help prevent confusion caused by similarity in your brand name. It may also prevent you from being sued if someone else has already registered a trademark on the same word or phrase. Some companies will immediately tell you whether another company has applied for a trademark using your same name or within a similar field of expertise.
If the company you are switching to tells you that another company has already chose to apply for trademark using your same name, they will likely ask if this is something that interests you. They may even offer to help negotiate with the other company so that they can keep their product name and logo.
If this isn’t an option and it seems like something could go wrong if someone else gets their hands on your product’s name, then maybe consider changing both names before applying for a new one.

If you have any confusion, talk to the company that wants to buy from you first before you try selling it on eBay or other websites. The first thing they will ask is: “What name do we need?”
If your trademark has been registered, then this is the place where you should start your search for a buyer. If not, then ask yourself why not? Is there some reason why you can’t make money using this name? Maybe it isn’t really yours after all; maybe someone else has registered a trademark before yours and now owns it legally as well!
If you’re a small business owner, don’t let someone else take your name. If you have a product or service to offer, consider trademarking it. As an added bonus, if you do trademark your product’s name, then no one else can use it either. It’s truly a win-win situation for both the business and your customers. If you’re going to sell something on eBay and you don’t have a trademark or other legal protection, then be sure that you are always clear about your rights, so that there is no dispute later!!
